1. Since both these bail applications are arising out of the same crime number, therefore, they are being heard and decided together by this common order.
2. These are the First Bail Applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested on 19.02.2021 in connection with Crime No.195/2021 registered at
Police Station Ambikapur, District Surguja (CG) for the offence punishable under Sections 394, 341, 427 R/w 34 of IPC.

As per the prosecution case, a report was made by one Ambikeshwar Prasad that while he was going with a truck bearing No.C.G.15 DG 8627 on 16.02.2021 and was going to Madhya Pradesh with Iron rods and on 17.02.2021 as soon as they reached to Mayura Sariya Factory at that point of time in a motorcycle bearing No.C.G.15 D.T. 5745 four to five persons came broke upon the glass of the truck and thereafter looted amount of Rs.19000/- and fled away.
4. Learned counsel for the applicants submit that on the trivial issue the incident happened and the charge-sheet in this case has been filed and no further investigation is necessary, therefore, the applicants may be released on bail.
5. Per contra, learned State counsel opposes the prayer for grant of bail.
6. Considering the fact that the charge-sheet in this case has been filed and the applicants are in jail since 19.02.2021, I am inclined to release the applicants on bail.
7. Accordingly, both bail applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
