Sam Koshy Order On Board 25/06/2018 This is the first bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicants who have been arrested in connection with Crime No.479/2017 registered at Police Station- Palari, District Baloda BazarBhatapar (CG) for the offence punishable under Sections 457, 380/34 of IPC.

The allegation against the present applicants is that they in connivance with co-accused are said to have committed theft at jewelery shop of Raj Kumar Sahu and have stolen large quantity of gold and silver ornaments and also huge amount of cash. 3.

Perusal of the case diary would reveal that from the possession of applicant no.1, Rs.1,40,000/- cash and large quantity of gold ornaments

and articles were seized whereas from the possession of applicant no.2, cash amounting Rs.,6,00,000/- was recovered. State counsel also brought to the notice of this Court the case of co-accused Digesh Sahu whose application for grant of bail has already been rejected by this court on 25.05.2018 in MCRC No. 2917/2018 where the nature of allegation against co-accused Digesh was similar.

Given the facts and circumstances of the case, this Court is of the opinion that it is not a fit case for grant of bail to the present applicants. Accordingly, the application filed under Section 439 of CrPC for grant of bail stands rejected.
