Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 17/11/2015 Heard finally with the consent of learned counsel for the parties.

(2) In this petition under Article 226 of the Constitution of India, the petitioners are challenging the Notifications dated 31.07.2014 and 21.07.2014, whereby, the Headquarter for newly constituted Gram Panchayat Khapariteli has been fixed at Khapariteli. (3) It is the submission of learned counsel for the petitioners that Khapariteli is having less population than the other constituent village of the said Gram Panchayat namely Khaparisidar, where the petitioners reside.

(4) The issue concerning the fixation of headquarter of a Gram Panchayat, alteration/amalgamation of Gram Panchayats and its limits has been considered and decided by this Court in the matter of Gramvasi Gram Khari Gram Panchayat Dhamni & another Vs. The Collector, Baloda Bazar & others1 (5) In view of the above, the instant writ petition stands disposed of in terms of Gramvasi Gram Khari Gram Panchayat Dhamni & another (supra).
