At this stage, learned counsel for the petitioner submits that this petition at this stage, may be disposed off with a direction to consider petitioner's pending departmental appeal against the order of penalty. When the appeal of the petitioner has remained pending without any decision, no useful purpose would be served in keeping the matter pending. This petition, at this stage, is therefore disposed off with the direction to Commissioner to decide petitioner's appeal within a period of four months. If

the petitioner is not satisfied with the order, he may take such remedy as may be available to him under the law.
