(2) The petitioner's earlier writ petition i.e. WP(C) No.3334 of 2009 on the same issue was dismissed by this Court in vide order dated 28.02.2012, which was afÏrmed by the Division Bench in Writ Appeal

No.279 of 2012. The second writ petition i.e. WP(C) No.995 of 2014 preferred by the petitioner was dismissed on 03.03.2015, against which, the writ appeal preferred by the petitioner bearing No.210/2015, was dismissed, as withdrawn. The said writ appeal was sought to be withdrawn for pursuing departmental remedies however, the Division Bench made no observation with regard to the same.
