Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/06/2017 Heard.

1. The petitioner has challenged legality and validity of the order/notice dated 16.5.2017 by which she is presently discontinued and she has been asked to submit her reply in the matter.

-22. The facts which are floating on the surface of the case are that during employment with erstwhile employer, there were certain allegation of misconduct and the petitioner had submitted resignation. In the order/notice challenged before this Court, there is an allegation that these facts were suppressed while offering candidature for appointment to the post of Social Worker under Chief Medical and Health Officer, Ambikapur. The petitioner has been asked to submit her reply. Learned counsel for the petitioner submits that the petitioner has also submitted a detailed reply but she had to approach this Court because on her reply, no decision has been taken till date.

3. Without commenting on merits of the case, in the opinion of this Court, the interest of justice would be served if, at this stage, this petition is disposed off with a direction to respondent No.5-Chief Medical and Health Officer, Surguja to take decision on petitioner's representation submitted pursuant to notice (Annexure P-1) within an outer limit of 30 days from the date of receipt of copy of this order.

4. In case the petitioner is not satisfied or her grievance is not redressed, it will always be open for her to take recourse to such remedy as may be available to her under Law.
