Hon'ble Shri Justice P. Sam Koshy Order On Board 30/06/2017 Heard.
1. The petitioner in the present writ petition has assailed the order dated 11.05.2017 passed by respondent No.5 which is a demand notice demanding Rs.237670/- from the petitioner which is an alleged amount which stood outstanding against the name of the petitioner. The petitioner retired under the respondents with effect from 31.03.2017 from the post of Senior Agriculture Development Officer.
2. The limited prayer of the petitioner is that let the petitioner be granted an opportunity to explain to the respondents as regards the details of this amount which is being shown as outstanding against his name. In the meanwhile, the respondents may consider the case of the petitioner in releasing the retiral dues payable to the petitioner subject to the withholding of the amount of Rs.237670/- which is the amount in dispute.
3. This prayer is not opposed by the State counsel.
4. Accordingly, the present writ petition stands disposed off with the direction that the petitioner shall approach the respondents No.3 & 5 and shall provide all the necessary explanation so far as the outstanding amount against his name. The respondents No.3 & 5 in term shall personally verify the records and shall take appropriate steps in releasing the retiral dues payable to the petitioner including pension to the competent authority at the earliest. The respondents No.3 & 5 are also directed to ensure release of the retiral dues payable to the petitioner after withholding of the amount in dispute.
5. Let this exercise be done by respondents No.3 & 5 within a period of two months from the date of receipt of copy of this order. The petitioner shall provide the certified copy of this order along with a representation and the details of the information before the competent authority within a period of two weeks from today. Upon receipt of representation and the order of this Court the respondents No.3 & 5 shall call upon the petitioner and granting full hearing decide upon the alleged outstanding that is shown against the petitioner.
