The applicant has moved this application under Section 439 of the Cr.P.C. for grant of regular bail in connection with Crime No.44/2019 registered at Police Station Lormi, District Mungeli for the offence punishable under Section 304-B/34 of IPC. The applicants were arrested on 04-02-2019. 2.
As per the version of the prosecution, Savita Rathore was married to Nitesh Rajput and it is alleged that Nitesh Rajput and the present applicants harassed the deceased on account of demand of dowry. 3.
Learned counsel for the applicant submits that the applicant-Sumitra Devi is mother-in-law of the deceased and Mukesh Singh Rajput is brother of the husband of the deceased and there is no prima facie case against the present applicants, therefore, they may be enlarged on bail. 4.
On the other hand, learned State counsel opposes the prayer for grant of
bail 5.
After going through the record, without commenting upon the merits of the case, I am inclined to enlarge the applicants on bail. 6.
Accordingly, the application is allowed. It is ordered that the applicants shall be released on bail on each of them furnishing a personal bond of Rs.25,000/- along with one surety of the like amount to the satisfaction of the trial Court on the condition that they shall appear before the trial Court regularly on each and every date of hearing, unless exempted. Certified copy as per rules.
