Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/10/2017 At the outset, learned counsel for the State submit that except gratuity and pension finalization, all other dues of the petitioner have been paid to the petitioner. Learned counsel for the petitioner does not dispute this fact. According to the State counsel, the main reason for non-releasing gratuity and non-finalisation of pension is that the petitioner has not appeared before the District Treasury Officer, Baloda Bazar along with necessary documents as directed to the petitioner vide order dated 27/07/2017 of the Divisional Forest Officer, Baloda Bazar.

This fact is being disputed by learned counsel for the petitioner. Be that as it may, let the petitioner appear before the District Treasury Officer,

Baloda Bazar within three weeks. He shall submit a representation and obtain acknowledgment of receipt. Within a period of 60 days from the date of petitioner's appearance before the District Treasury Officer, necessary formalities shall be completed on petitioner submitting necessary documents as required and gratuity shall be released and pension case shall also be finalized. At this stage, looking to the fact that a substantial amount has already been paid to the petitioner, I am not inclined to proceed further in the matter. Rule is therefore discharged.
