1. Heard.

2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.287/2020, registered at Police Station Supela, District Durg (CG), for the offence punishable under Section 397 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case the accused persons enquired about some route from the complainant who was driving a truck at about 11.00 pm on 13-5-2020 and thereafter, looted a sum of Rs.3,500/- from him. Co-accused Ankur Sharma has been released on bail by this Court in M.Cr.C.No.3868 of

2020 (decided on 4-8-2020) whereas another co-accused Mani @ Rajendra Singh has been allowed bail in M.Cr.C.No.3871 of 2020 (decided on 4-8-2020).

4. Learned counsel appearing for the State, per contra, would oppose the bail application.

5. Considering the entire facts situation of the case, particularly considering the fact that the similarly placed co-accused persons have already been released on bail, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application M.Cr.C.No.4073 of 2020 is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
