Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 04-02-2019 in connection with Crime No.14/2019 registered at P.S. - Khamtarai Raipur, Civil and Revenue District Raipur, Chhattisgarh for the offence under Section 379, 411/34 of the IPC. 2.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 04-02-2019. The applicant is just 21 years old young man and he has no criminal antecedent. Therefore, it is prayed that he may be granted regular bail. 3.

Learned counsel for the State/non-applicant opposes the application submitting that the theft committed in this case is of huge scale, therefore, the applicant is not entitled for grant of bail.

Heard learned counsel for the parties and perused the case diary. 5.

According to the FIR lodged, truck bearing registration No. C.G.04 JE

-20277 loaded with steel was stolen by some unknown person. During investigation this applicant was apprehended, who has stated on memorandum regarding recovery of the stolen article. Hence, this case. 6.

Considering on the age of the applicant and also that he has no criminal antecedent and lastly that the case is triable by JMFC, I feel inclined to allow this application.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
