1. The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.221/2021 registered in Police Station Police Chowki Balauda, Saraipali, District Mahasamund C.G. for the offence punishable under Section 20(A) of the NDPS Act.

2. Applicant was found growing two cannabis plants having length of 9-8 feet respectively and both together carrying

MCRC No. 4245 of 2021 weight of 3.630 kg, in his agricultural field.

3. Learned State counsel would oppose the prayer for grant of bail, however, he would submit that the concerned SHO has not reported any previous criminal antecedent of the applicant.

4. Considering that the applicant is in jail since 01.6.2021 i.e., for more than 2 months and the charge sheet has already been filed, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
