Learned counsel for the petitioner would submit that by the impugned order, the petitioner has been transferred from Govt. Middle School, Potiyadih to Govt. Middle School, Bijnapuri for teaching Maths and the petitioner has wrongly been declared as surplus teacher. He would further submit that the District Education Officer has no right to transfer of petitioner.

Be that as it may, the petitioner is directed to make fresh

representation before the Collector, Dhamtari, who in turn shall consider and decide the representation within a month in accordance with law.

The effect and operation of the impugned order dated 03/11/2015 shall remain stayed for four weeks. 4.

With the aforesaid observation/direction, writ petition stands finally disposed off. It is made clear that this Court has not expressed any opinion on the merit of the case.
