Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 17/07/2017 The petitioner has filed this petition seeking a direction to respondents to consider petitioner's grievance arising on account of incorrect fixation of seniority on the post of Assistant Grade -I. It is submitted that when the gradation list was issued, the petitioner, aggrieved by his placement in the gradation list, preferred a representation on 27/01/2015 followed by reminders, but till date, no decision has been taken.

In the matters of seniority, the dispute should be settled as early as possible. The petitioner has submitted representation. Respondent No.2 ought to have taken appropriate decision on the representation at the earliest. Let it be done now. The decision on the representation shall be taken within 60 days from the date of receipt of copy of this order and a speaking order may be passed.

It goes without saying that if the petitioner is not satisfied with the decision of representation, he would be at liberty to take recourse to remedy as may be available to him under the law.
