1. Heard.

2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.7/2020, registered at Police Station Chilhati, District Rajnandgaon (CG), for the offence punishable under Sections 306 & 498-A of the Indian Penal Code.

3. Applicant used to ill treat and commit physical cruelty upon his wife in a state of intoxication almost regularly. Being frustrated with her life she committed suicide by setting herself ablaze.

4. Learned counsel appearing for the State would oppose the bail application.

5. Having considered all the relevant aspects of the matter and for the fact that there is no allegation of commission of cruelty for demand of dowry and also considering the fact that the applicant is in detention since 23-5-2020 and further considering the fact that the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

6. Accordingly, the bail application M.Cr.C.No.3981 of 2020 is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
