1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.203/2016 registered in Police Station City Kotwali, Raigarh Distt. Raigarh for the offence punishable under Section 420/34 of the I.P.C. and Section 6, 10 of C.G. Protection of Depositors Interest Act, 2005.
2. Applicant along with co-accused Ashok Joshi induced victims for making investment for share trading through them, however, after obtaining payment of Rs.2,40,000/-
MCRC No. 4129 of 2021 they closed the office and were not traceable since after the year 2016.
3. Learned State counsel would oppose the prayer for grant of bail on submission that applicant was absconding for last about four years, therefore, he is not entitled to be released on bail.
4. Considering that the applicant is a resident of village Sahupara, District Janjgir Champa and is not an outsider as also for the reason that presently he is in jail since 03.6.2021 and the offence is triable by JMFC, I am inclined to release him on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
