Hon'ble Shri Justice P. Sam Koshy Order on Board 05/07/2021

1. The present MCC has been filed seeking for modification of the Order dated 3.3.2021 passed by this Court in WPS No.1391/2021.

2. The modification sought for is to the extent that the status of Petitioner No.49 has been wrongly reflected as Lecturer (L.B.) whereas in-fact she is a Teacher (L.B.). Likewise, the School where the Petitioner No.49 was posted also has been wrongly mentioned as Higher Secondary School whereas it was only a Middle School.

3. Learned Counsel for Applicants prays for modification of the Order to that extent and also seeks permission to carry out necessary amendments in the original Writ Petition also, as the error has arisen on the part of the Counsel for Applicants/Petitioners at the time of drafting the Writ Petition.

4. The limited modification sought for does not opposed by learned State Counsel, subject to verification of facts at the departmental level.

5. Accordingly, the Order dated 3.3.2021 passed in WPS No.1391/2021 is modified to the extent that the status of Petitioner No.49 shall be read as "Teacher (L.B.)" instead of "Lecturer (L.B.)" and similarly the School at which she was posted shall be read as "Middle School" instead of "Higher Secondary School".

6. Learned Counsel for Applicants/Petitioners at the same time is also directed to ensure that within a period of 3 days he shall carry out the necessary amendments in this regard in the record of WPS No.1391/2021 as well and only thereafter he shall be entitled for the certified copy of the order passed by this Court in the present MCC.

7. Let a copy of this Order be made a part of the record of WPS No.1391/2021 as well.
