1. Alleging non compliance of court's order dated 22.02.2017 passed by this court in Writ Petition (S) No.909 of 2017, the instant contempt petition has been preferred by the petitioner.
2. Learned counsel for the State/respondent submits that on verification and scrutiny of the GPF account of the petitioner it is reflected that on an earlier occasion on the application moved by the petitioner, an amount of Rs.1,90,000/- has already been released to him and as on date there is balance of Rs.2,58,000/- in his GPF account. He further makes a statement that in case if the petitioner further needs any more withdrawal from his GPF account, he would have to move a suitable fresh application and on such application being made, the concerned department shall proceed and decide the application promptly.
3. In view of the aforesaid statement made by the State counsel on instruction received from the department, this court is of the opinion that no fruitful purpose would be served by keeping this contempt petition
pending and the same is accordingly dropped at this juncture with liberty to the petitioner to move appropriate fresh application to the concerned department for part withdrawal of the GPF amount which is lying to his credit.
4. Needless to mention that in the event the grievance of the petitioner still survives, he would be at liberty to avail other remedies available under law.
