(2) Learned counsel appearing for the State/respondents submits that the impugned order dated 05.08.2015 (Annexure P-1) passed by the respondent No.3-Sub-Divisional Officer (Revenue), Bemetara, District Bemetara is appealable before the State Government, who is appellate authority for the

relevant reliefs.

(3) At this stage, learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the concerned appellate authority within a period of two weeks from today.

(4) The prayer appears to be fair and reasonable. (5) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed within a period of two weeks from today, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of three months from the date of receipt of the appeal of the petitioner.

(6) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
