The instant application (Cr.M.P.No.934/2018) has been filed to recall the order dated 10.01.2018 whereby Cr.M.P. No.1422 of 2017 has been dismissed for want of prosecution.

It has been stated that because of the default of the counsel to spot the case in the cause list, counsel failed to appear on 10.01.2018 when the matter was taken up on 10.01.2018.

On due consideration of the ground mentioned in the application and for the reason that merit is given preference for adjudication, the order dated 10.01.2021 is recalled.

Accordingly, the application for restoration is allowed and the Cr.M.P.No.1422/2017 is restored to its original number. The matter be listed for hearing before appropriate Bench. Sd/- GOUTAM BHADURI JUDGE R a o
