2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.126/2019, registered at Police Station Kotwali, Dhamtari (CG) for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code.
3. The applicant and other accused persons floated the company and later on were actively managing the affairs of the company who have collected an amount to the tune of Rs.36.00 crores from the depositors, but the same has not been returned, despite assurance.
4. At this stage, learned counsel appearing for the applicant seeks permission of this Court to withdraw this bail application with liberty to move again at an appropriate stage.
5. No objection from other side.
6. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated supra.
