Hon'ble Shri Justice Gautam Chourdiya Judgment on Board 27.09.2021

1) The appellant has preferred this appeal under Section 14 (A) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 as the appellant was arrested on 03.03.2021 in connection with Crime No. 46/2021 for offence under Sections 376 of IPC & Section 3 (2) (v) of SC/ST Act, registered at Police Station- Ajak Surajpur, District- Surajpur (C.G.).

2) The prosecutrix has appeared through Video Conferencing and she raised objection to the appeal filed by the appellant for grant of bail.

3) The matter was passed over once for want of any representation on behalf of the appellant. No one appears for the appellant even in the second round.

4) In these circumstances, there is no other option left with the Court, but to dismiss this appeal for want of prosecution.
