Shri Narendra Singh Chouhan, the Officer-in-Charge of the case and Assistant Health Officer in the Municipal Corporation and who is also dealing with the tender in question as was informed to us by him during the proceedings, is present and informs us that the Respondent/Corporation shall not finalize the tender without consideration of the representation filed by the Petitioners on 5.12.2015.

We put a specific question to him in presence of the Learned Counsel for the Corporation if he has been authorized to make this statement or not. He assured us that as the Officer-in-Charge of the case, he is not making any statement before us without obtaining proper instructions from the concerned authority.

In view of the specific statement made by Shri Chouhan, no further orders need be passed by us.
