Proceedings through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag.CJ Order On Board 03/08/2021

1. The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.81/2021 registered in Police Station City Kotwali, District (Revenue & Civil) - Balodabazar-Bhatapara C.G. for the offence punishable under Sections 294, 506, 307 of the I.P.C. and Sections 25, 27 of the Arms Act.

2. On a dispute arising out of WhatsApp message sent by the

MCRC No. 4254 of 2021 applicant to Sangeeta, cousin of injured Krishnakant Dhruv, applicant inflicted knife blow on the person of Krishnakant Dhruv and Kaushik Ram Dhruv. While Krishnakant has received grievous injuries on paraumbilical region (abdomen), Kaushik Dhruv has sustained simple injury.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the fact that applicant is in jail since 30.1.2021 i.e., for more than 6 months; charge-sheet has already been filed and the genesis of the incident, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
