NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WRIT PETITION (S) NO. 3423 OF 2018 • Ira Parmanik, aged about 64 years, W/o Shri T.K. Pramanik, R/o H. No.90, J.P. Vihar Colony, Mangla, Bilaspur, Dist. Bilaspur (CG) ... Petitioner versus 1.

State of Chhattisgarh, through the Secretary, Department of Urban Administration and Development, Indravati Bhawan, Naya Raipur, District Raipur (CG) 2.

Municipal Corporation Chirmiri, through the Commissioner, District Koriya (CG) ... Respondents For Petitioner :

Mr. Shailja Shukla, Advocate.

For Respondent No.1 :

Mr. Shashank Thakur, Govt. Advocate, on advance copy.

For Respondent No.2 :

Mr. Sudeep Agrawal, Advocate.

Hon'ble Shri Justice P. Sam Koshy Order on Board 01/05/2018 1.

Heard on admission.

2.

Mr. Sudeep Agrawal, Advocate, present in the Court, who usually appears on behalf of Municipal Corporation Chirmiri, is directed to accept notice on behalf of Respondent No.2.

3.

With the consent of the learned counsels appearing for the parties, the matter was heard finally at the admission stage itself. 4.

The only grievance of the Petitioner is that though she has been retired from service on 30.6.2016 but certain retiral dues payable to her like leave encashment and arrears of pay scale have not been paid to her. 5.

Considering the limited prayer made by the Petitioner, this Court is not inclined to keep this petition pending any further, rather ends of justice would meet if the writ petition itself is disposed of with a direction to Respondents No. 1 and 2 to consider the representation made by the Petitioner for granting of retiral dues which have not yet been paid to her and to issue appropriate orders for the release of the same if she is otherwise entitled under the law.

6.

Let this exercise be done within a period of 3 months from the date of receipt of certified copy of this order.

7.

It shall be the responsibility of the Petitioner to place the certified copy of this order before the concerned authorities. 8.

With the aforesaid direction/observation, the writ petition stands disposed of.
