1. The present writ petition is the petition of the Gram Panchayat Ranvirpur, Tehsil Sahaspur Lohara, Distt. Kabirdham. The primary grievance is in respect of alleged encroachment made upon the
Government land by the private respondents and in the process have blocked the public pathway to the community Hall built by the Gram Panchayat.
2. Counsel for the petitioner submits that present petitioners have already approached the respondents No.2 to 4 for redressal of their grievance by moving detailed representation. However, no decision as such have been taken by the authorities till date.
3. Given the limited relief that petitioner has raised, this Court is of the opinion that writ petition can be disposed of directing the respondents No.2 to 4 to take appropriate remedial measures redressing the grievance of the petitioner strictly in accordance with the provisions of law at the earliest preferably within a period of 90 days.
4. It is expected that since allegation of petitioners is in respect of an alleged illegal construction on the public pathway, respondent No.2 to 4 shall also consider the request of the petitioner for grant of interim protection as of now so as to avoid any blockage to the road, if any.
