The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.39/2018 registered in Police Station Komakhan, District Mahasamund (C.G.) for offence punishable under section 394/34 of IPC.

As per the prosecution case, on 24/03/2018 FIR was lodged by Hemlal Sahu that the applicant assaulted him and looted bike. Thereafter on the memorandum of the applicant bike was recovered alongwith that bike another six bike of the like nature which was looted was also recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and simple dispute has been aggravated as wrong report has been made, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Taking into fact that TIP was conducted wherein the applicant was

identified and apart from loot of one bike another six like nature of offence appears to have been committed. Taking into background and totality of the case, I am not inclined to release the applicant on bail. 6.
