It is found that though the petitioner was continuing by virtue of interim order passed by this Court in his faour in WPS No.4733 of 2016 vide order dated 14-09-2016.

Without seeking leave of the Court, the petitioner was again subjected to transfer, therefore, in these circumstances, impugned order in respect of the petitioner cannot be sustained in law and therefore set aside. As WPS No.4733 of 2016 has already been disposed off by this Court, the State Government would be at liberty to pass a fresh order in the public interest and exigency so requires. 4.
