1. Heard.

2. The applicants have preferred the first bail application under Section 439 of the Cr.P.C., as they are arrested in connection with Crime No.08/2021, registered at Police Station - Bortalav, DistrictRajnandgaon (C.G.) for the offence punishable under Section 294, 323, 324, 506, 452, 307, 34 of the Indian Penal Code and Section 25, 27 of the Arms Act.

3. The applicant No.1 Naresh Verma is son-in-law, whereas the applicant No.2 Mukesh Verma is Bhanja of injured Yograj Lodhi. At about 5 p.m. on 15-02-2021, applicants entered the house of the injured and after

MCRC No. 4055 of 2021 raising a dispute about partition of land, filthily abused and assaulted him by means of sharp edged weapon.

4. As per the statement of the injured, the injury has been caused by applicant No.1 Naresh Verma and further that previously also, Naresh Verma had raised quarrel and assaulted him but being his son-in-law, he did not lodge the report.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering the allegation against the applicant No.1 Naresh Verma, his bail application is dismissed reserving liberty in favour of the applicant to revive the prayer after examination of the injured.

7. As against the applicant No.2, Mukesh Verma, there is no allegation of causing injuries to injured Yograj Lodhi. He is in jail since 02-03-2021 and the charge sheet has already been filed, therefore, this Court is inclined to release the applicant No.2 Mukesh Verma on bail.

8. Accordingly, the bail application in respect of applicant No.2 Mukesh Verma is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
