This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.12 of 2018, registered at Police StationMahila Thana, District- Bilaspur (CG), for the offence punishable under Sections 354/34, 509 of the IPC.

Case of the prosecution, in brief, is that, on 25.02.2018 the applicants outraged modesty of the complainant and threatened her also, thereby, committed the offence.

Learned counsel for the applicant would submit that the
applicants have not committed any offence and they have falsely been implicated in the crime in question. Charge-sheet has been filed. They are in custody since 26.02.2018.

On the other hand, learned counsel for the State opposes the bail application.

I have heard counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case, nature and gravity of the offence, pre-trial detention, charge-sheet has been filed, I am of the opinion that present is a fit case for grant of regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicants shall be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- each with one surety in the like sum to the satisfaction of the concerned Court for their appearance as and when directed.
