1. Petitioner is a student of B.Ed. Course at Aryavart Shiksha Mahavidyalaya, Ruabandha, Bhilai, Durg Chhattisgarh, respondent No.2. He was admitted to the said course on the strength of his merit position in the B.Ed. Admission Test, 2015.

2. The present writ petition has been preferred for a direction to respondent No.1 for issuance of eligibility certificate for appearance in the B.Ed. Examination, which is to commence from Monday i.e. on 11.01.2016.

3. Shri Shrivastava, learned counsel appearing for respondent No.1 would draw attention of the Court to the document Annexure R-1/1, which is a

letter written by respondent No.1 to the petitioner for submission of appropriate application along with the required fee, so that his prayer for issuance of eligibility certificate is considered in accordance with law. He would submit that despite its communication, the petitioner has not moved any application before respondent No.1.

4. It appears, on submission of application along with the required fee, the University is ready to consider the case of the petitioner in accordance with law. Therefore, the writ petition is disposed of with a direction that in the event, the petitioner prefers an application before respondent No.1 University along with requisite fee by 11:00am tomorrow, the University shall consider and decide the issue of grant of eligibility certificate by tomorrow itself because the examination is to commence from Monday i.e. 11.01.2016.

5. Depending upon petitioner's eligibility in accordance with law, the University may permit the petitioner to appear in the examination provisionally.
