The applicant has preferred this fourth bail application under Section 439 of the Cr.P.C. for grant of bail as she has been arrested in connection with Crime No.230/2018, registered at Police Station Dabhra, District Janjgir-Champa (CG), for the offence under Sections 294, 323/34, 506-B, 302 and 307 of the Indian Penal Code.

Three earlier bail applications of the applicant have been dismissed on merits, however, the present applicant, a lady,

MCRC No.4596 of 2021 aged about 32 years, is in jail since 26-10-2018, this fourth bail application was admitted for hearing.

On a dispute arising out of throwing of disposable plastic glasses (tumblers) on the street, in front of the house of Keshav Prasad Chandra (since deceased), the accused Gaurishankar caused injuries over his person by iron rod and when informant Kshiti Bhushan, son of the deceased, tried to intervene, co-accused Kashi Prasad inflicted injuries over his person by club. At this moment, applicant reached the spot and assaulted the deceased with hand & fist.

Learned counsel for the State, per contra, would oppose the bail application.

Considering the entire facts situation of the case; further considering the fact that the applicant is, a lady, aged about 32 years; as also for the fact that the applicant is in jail since 26-10-2018; and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
