Grievance of the petitioner in the instant case is that against the order of punishment dated 8.4.2016 he had preferred an appeal before the appellate authority on 24.5.2016, but till date though two years have passed the appeal of the petitioner has not been decided. Meanwhile, the respondent authorities have again initiated disciplinary proceeding against the petitioner for the same misconduct for which he already stands punished. Against the said initiation of disciplinary proceeding, the petitioner has preferred a representation before respondent no.1 on 25.4.2017 raising objection in respect of the maintainability/initiation of subsequent disciplinary proceeding.

Given the facts and circumstances of the case, ends of justice would meet if the writ petition itself is disposed of with a direction to respondent no.1 to decide the objection so raised by the petitioner at the earliest preferably within a period of 60 days from the date of receipt of certified copy of this order.

It shall be the responsibility of the petitioner to place the certified copy of this order before the concerned authorities. 4.

With the aforesaid direction/observation, the writ petition stands disposed of.
