Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/08/2017 The petitioners have filed this petition seeking a direction to grant of regular pay scale.

After going through the petition, it is found that the petitioners are working in a private aided institution and upon representation earlier made by the petitioner, the State required the institution vide its memo dated 17/05/2017 and 17/07/2017 to take necessary decision and forward the same to the Government but till date, decision has not been taken by the Management of the private institution due to which, petitioners have filed this petition.

Considering that the matter is still pending consideration with the appropriate authority and decision has not been taken, at this stage, this petition is finally disposed off with a direction to respondent No.5 to send its own recommendation to the Government in response to Government's letter dated 17/05/2017 and 17/07/2017 (collectively filed as Annexure P/5) within a period of two months from the date of receipt of copy of this order. Thereafter, the State shall take decision in the matter within a period of three months.

The entire exercise shall be taken within five months. In case, decision goes against the petitioner, it will be open for the petitioner to take appropriate remedy. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
