1. The petitioner has challenged the order dated 14.8.2017 by which he has been transfered from Raipur to Bijapur.

2. It is submitted that the petitioner, a weight lifter, was appointed under the sport quota. In the State of Madhya Pradesh, a Memo was issued way back on 4.8.1990 stating that those who have been appointed in the State quota of Sport should be posted only in selected Sports Centers and not at a place where there is no proper facility of practice. It is submitted that earlier also when the petitioner was transferred, a petition was filed before this Court

-2and this Court had disposed off the petition vide order dated 22.2.2013 passed in WPS No.873/2012 directing consideration of petitioner's representation in the light of the fact that the petitioner has to be posted at a place where facility of training of power lifting is available. Thereafter, the petitioner was allowed to continue and now again he is being transferred.

3. It is for the concerned respondent authority to examine whether at the place where the petitioner is being transferred, there is facility of training of power lifting or not. This matter can be best examined by respondent transferring authority.

4. Therefore, it would be appropriate to dispose off this petition with a direction to the respondents to examine the aforesaid aspect of the matter in the light of earlier circular issued by the Government. The decision be taken within an outer limit of six weeks and for a period of six weeks, no coercive steps shall be taken against the petitioner.

5. The petition is accordingly disposed off.
