Mr. B.P. Singh, learned counsel for applicant seeks permission of this Court to withdraw this application. However, he submits that as the applicant is a Government servant and as per documents filed along with application that there is settlement between applicant and complainant, a direction may be issued to the Court below concerned for considering bail application of present applicant on the same day, if filed by him after his surrender.

Mr. Roshan Dubey, learned State Counsel submits that he is not having objection, if any such direction is issued.

Mr. Shikhar Baktiyar, learned counsel for the Complainant submits that today itself, he has filed memo of appearance on behalf of complainant. The memo of appearance is not part of record.

Accordingly, this bail application is dismissed as withdrawn. If an application for grant of regular bail is filed by applicant after his surrender, the Court below concerned may try to consider and decide it on the same day in accordance with law.
