-1NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 4153 of 2017 Chandra Shekhar Kehri S/o Late Shri K.L. Kehri, Aged About 53 Years R/o Lig 997, Sector - 6, Housing Board Colony Saddu, Raipur, Distt. Raipur (C.G.), Presently Posted As Assistant Manager, Head Office Raipur, Chhattisgarh Hadicraft Development Board, Raipur, Distt - Raipur (C.G.). ---- Petitioner
Versus
1. State Of Chhattisgarh Through : Secretary, Department Of Rural Industries, Mahanadi Bhawan, Mantralaya, Capital Complex, Naya Raipur, District Raipur, Chhattisgarh.
2. Managing Director, Chhattisgarh Handicraft Development Board, Chhattisgarh Haat Parisar, Mahalaxmi Cloth Market Pandri, Raipur, District - Raipur, Chhattisgarh.
---- Respondents For Petitioner : Shri Ashish Beck, Advocate For State :
Shri Satish Gupta, Govt. Advocate S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/08/2017 Heard.
1. The petitioner's grievance is that though the petitioner had served in the scheduled area for about 7 years and thereafter he was posted at Raipur, within a period of less than 2 years, the petitioner has again been transferred to a scheduled area. It is submitted that this violates the Govt. policy of transfer promulgated on 11.7.2017.
2. There is no material on record to show that the said policy has been also applicable to Chhattisgarh Handicraft Development Board of which the petitioner is an employee. There may be some hardship also because of
-2illness of wife of the petitioner.
3. The aforesaid grounds do not make out a case for interference in the absence of there being any policy applicable to the case of the petitioner that one who has remained posted in scheduled area in past would not be sent back to the same area.
4. Therefore, in these circumstances, this Court does not find any case for interference. However looking to the personal difficulty, it would be open for the petitioner to prefer representation to the transferring authority who will decide the same within a period of 4 weeks from the date of submission of representation.
5. The petition is accordingly finally disposed off. Sd/- (Manindra Mohan Shrivastava) Judge Praveen
