Grievance of the petitioner is that after the award was passed in favour of father of the petitioner, the award was not executed and father of the petitioner was died. Thereafter, the petitioner had also moved an application before the concerned Labour Commissioner for passing appropriate order, but till date, no decision has been taken.

In case, any award is passed by the Labour Court in favour of workmen, for execution of award and payment of money due and payable under the award, the remedy has been prescribed under Section 33 of the Industrial Disputes Act. The petitioner may invoke jurisdiction by moving an application under Section 33(1) of the Industrial Disputes Act, the said application is required to be decided expeditiously.

In view of above, it is directed that the Labour Commissioner or any other authority to whom, may be entrusted by the Labour Commissioner, shall take appropriate decision on petitioner's application in accordance with law. 5.
