This petition has been filed by the petitioner for recovery of his Bhumiswami land from Gram Panchayat Gatadih/ respondent No.5.

On petitioner's own showing, he has already approached the Tahsildar and a report has been submitted before the Tahsildar by the Revenue Inspector, Bhatgaon. In the absence of there being any other material, it has to be presumed that the proceedings are pending before Tahsildar. Therefore, the instant petition is misconceived in law and is dismissed with the liberty to the
