From the record, it appears that subsequent to filing of the present appeal, on 16.6.2003 the appellant filed Criminal Appeal No. 810 of 2003 in respect of same trial for which the present appeal has been filed. 2.

Subsequent appeal filed by the appellant has already been decided by this Court vide Judgment and order dated 12.2.2009. 3.

In view of the fact that the appeal filed by the appellant has already been decided, the present appeal does not survive and the same is accordingly dismissed.
