Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board 24/09/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.122/2020 registered in Police Station Takhatpur, District Bilaspur for offence under Section 363, 366A, 376 of the IPC and Sections 4 & 6 of the Protection of Children from Sexual Offences Act.

2. IA No.1/2021, application for condonation of delay in payment of Process Fee is allowed.

3. The matter is posted for orders on default. However, the prosecutrix is present before this Court on the basis of notice served on her by the concerned SHO.

4. This is the 2nd bail application on behalf of the applicant. The first bail application was dismissed with liberty to revive the prayer after examination of the prosecutrix.

5. Having seen her deposition, as also for the fact that the prosecutrix, aged about 14 years, has appeared before this Court to object the applicant's application for grant of bail and the case diary is also available, I am not inclined to release the applicant on bail. Accordingly, the Application is rejected.
