1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.58/2020 registered in Police Berla, District Bemetara C.G. for the offence punishable under Sections 376 (2)(i)(n) of the I.P.C. and Section 5(l), 6 of the Protection of Children from Sexual Offences Act, 2012.

3. Case of the prosecution, in brief, is that applicant committed forcible sexual intercourse with the prosecutrix during her minority on promise to marry but later on refused to marry her.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the entire fact situation of the case, this Court is not inclined to release the applicant on bail at this stage.

6. Accordingly, the bail application is rejected reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.
