Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.429/2021 registered in Police Station Ambikapur, District Surguja for offence under Section 20 (B) of the NDPS Act.
2. On receiving secret information that the accused persons are engaged in sale of psychotropic substance, a raid was conducted in which the present applicant along with co-accused Mohd. Yakub Khan, Ahmed Qureshi @ Tarzan, Arman Hussain, Harvinder Singh and Vikash Kashyap were found in illicit possession of different quantities of
MCRC No. 4259 of 2021 contraband and the same was stored in the house of co-accused Mohd. Yakub Khan.
3. Admittedly, the bail applications of co-accused Ahmed Qureshi @ Tarzan and Harvinder Singh have been dismissed by the coordinate Bench in MCRC Nos.3711/2021 & 5333/2021 respectively.
4. Considering the entire fact situation of the case and for the fact that the bail applications of similarly placed co-accused persons have already been dismissed, I am not inclined to release the applicant on bail.
