The applicant has preferred this second bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.404/2016, registered at Police Station Chakarbhatha, District Bilaspur (C.G.) for the offence punishable under Sections 498-A, 506, 377, 34 of IPC.

The first bail application was dismissed on merits on 23.11.2017 in MCRC No.5269/2017 reserving liberty in favour of the applicant to repeat the prayer after examination of the complainant.

Considering the deposition of the complainant and for the reason that the applicant is in jail for near about 10 months and the offences are trialable by the JMFC, this Court is inclined to release the applicant on bail. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
