Learned counsel for the petitioner would submit that the petitioner was awarded contract in the year 2014 to construct stadium at BalrampurRamanujganj. He would submit that the petitioner started the work and thereafter certain litigation cropped up, therefore the petitioner was asked to complete the work on the rest of the remaining land which was not involved in litigation and therefore the work was carried out and completed to the extent of 65%. Learned counsel submits that despite the completion of work, the petitioner was not paid the single amount on the ground that fund is not available. Learned counsel submits that under the circumstances, the petitioner has made a representation to the respondent No.5 since 2017 but the same is not being decided. He would further submit that the security amount made by the petitioner is also required to be returned and the petitioner though was willing but he was not allowed to

complete the job at the behest of respondent No.5. 2.

Without going into merit as to the claim of the petitioner, since at this stage limited prayer has been made to decide the representation made by the petitioner which appears to have been filed before the respondent No.5, Chief Municipal Officer, Municipal Council, Balrampur, therefore respondent No.5 Chief Municipal Officer, Municipal Council, Balrampur is directed to decide the representation of the petitioner by a speaking order within a period of 60 days from the date of receipt of copy of this order.
