(1) Learned counsel appearing for the petitioner submits that in view of the reply filed by the respondents, the petitioner may be permitted to file appeal before the Excise Commissioner, Raipur.

(2) On the other hand, learned counsel for the State has no objection.

(3) Permission is granted.

(4) Accordingly, the petition is dismissed as withdrawn with liberty to file the appeal in accordance with the Act/Rules before the Excise Commissioner, Raipur. If such, an appeal is filed before the Excise Commissioner, Raipur, the said appeal shall be considered in accordance with law expeditiously.
