1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.30/2021 registered at Police Station Khallari, District Mahasamund (CG) for the offence punishable under Sections 427, 323, 506, 307 of the IPC and Section 3 of the Prevention of Damage to Public Property Act, 1984.

3. While driving the tractor and passing through the National Highway between Mahasamund and Bagbahar, the applicant did not stop at the barrier erected by the local Police and ran over the same and in the process, caused injuries to three Constables and the Town Inspector.

4. Learned counsel for the State would vehemently oppose the bail application.

5. Considering the nature of injuries sustained by the injured persons and for the fact that the applicant is in jail since 18.2.2021 and the charge sheet has already been filed, I am inclined to release the applicant on regular bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
