Shri Gary Mukhopadhyay, GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/08/2016 Challenge to the transfer order dated 12-07-2016 is made on the ground that the petitioner has been transferred without approval of the Minister. 2.
Learned State counsel has placed before the Court a copy of Circular dated 12-09-2014, in which, it has been clearly stated that despite there being provisions contrary to the transfer policy issued from year to year, the Collector is competent to transfer the officer of the rank of Tahsildar, Nayab Tahsildar, Revenue Inspector and Patwari within the district. Therefore, the order impugned is not liable to be interfered on the ground that it is without jurisdiction and competence. 3.
On the ground stated above, no relief can be granted. If the petitioner has any other difficulty, as per transfer policy, it will be open for the petitioner to prefer
representation to the competent authority on the grounds available under the transfer policy.
