Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/08/2016 The transfer order has been challenged by the petitioner mainly on the ground that the petitioner's wife is posted as Patwari in Jarhagaon, Mungeli and the petitioner is posted in Government College, Ratanpur, which are nearby stations and now the petitioner is being transferred to Narayanpur which is too far away.

On petitioner's own showing, the petitioner is continuing at this place for about five years. It appears that due to vacancy caused at Narayanpur, petitioner has been transferred. As against administrative exigency, the

petitioner has sought consideration of his posting to a place which is nearby the place of posting of his wife.

Considering the totality of circumstances, all that can be done at this stage is to direct the transferring authority to consider the representation of the petitioner to post him at a place nearby the place of posting of his wife or to post his wife at a nearby station, where the petitioner has now been transferred. The decision shall be taken within a period of four weeks. 4.
