2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.129/2020 registered at Police Station Bhatgaon for the offence punishable under Sections 376, 506 of the IPC and Section 67(A) of the IT Act.

3. The applicant has committed forcible sexual intercourse with the prosecutrix on the pretext of marriage. During video call, the applicant would request the prosecutrix to undress and then, record her video and thereafter, he would threaten to make it viral in the social networking site. However, the applicant later on refused to marry the prosecutrix.

4. Although the prosecutrix is more than 18 years of age, but considering the manner in which the applicant not only refused to marry the prosecutrix but also recorded her obscene video, this Court is not inclined to release the applicant on regular bail.

5. Accordingly, the bail application is dismissed with liberty to revive the prayer after examination of the prosecutrix. Sd/- (Prashant Kumar Mishra) Judge Shyna
